Fly Bali Heli and/or the pilot in command shall have the final authority on whether or not any flight shall be undertaken, the suitability of landing and take-off areas, the loading of the aircraft, the carriage of passengers if they are behaving in an odd or offensive manner and all other factors which in their opinion affect flight safety. Customers shall accept all such decisions as final. The pilot may order the Aircraft grounded if, in his/her opinion the aircraft is not in a condition to fly, the weather is not suitable for flying, or for other reasons of safety the flight should not proceed. Fly Bali Heli shall not be responsible for any loss, claim, cost or expense occur as a result of any decision made by Fly Bali Heli or pilot in accordance with this clause.
Customers shall acknowledge that the DGCA of Indonesia has the right to revoke, suspend or cancel permissions, approvals or certifications for the operation of the Aircraft and in respect of the provision of the Helicopter Services. Customers and Clients shall use its best endeavor to comply with the requirements or conditions imposed by the DGCA of Indonesia.
Payload limitation & maximum number of passengers is non-negotiable. Flight is not allowed to operate if the payload is exceeding the maximum capacity. A total payload limitation applies for total passengers and luggage.
No smoking or consumption of alcohol is allowed on board the helicopter.
Fly Bali Heli reserves the right to use passenger photos for Fly Bali Heli social media purpose with your consent.
Fly Bali Heli reserves the right to deny boarding or refuse the carriage of any person and reserve the right to back to heliport if the condition present an actual or potential safety hazard or risk (including but not limited to impairment and intoxication from alcohol or drugs) to our passengers, crew, staff or property.
Full payment is required to confirm the booking.
Cancelation (by the Customers) within 7 days before the flight date, Fly Bali Heli will return the entire booking amount minus IDR 1.000.000 as the administration fee.
Cancelation (by the Customers) within 24 hours before the flight date Fly Bali Heli will charge cancelation fee of 20% from the total booking amount.
Cancelation (by Fly Bali Heli) due to bad weather, Force Majeure aircraft condition, NOTAM, late arrival from previous flight , security and government issues, then no fees are payable by the Customers
Customers can re-schedule the flight. Changes will be free of charge until 48 hours before departure. For changes made less than 48 hours before departure, we charge IDR 1.000.000
When unsuitable weather on the day of the Customers’s flight exist (with no signs of improvement forecast), the flight may be re-scheduled at a time that is mutually convenient.
If the Customers is unable to fly at any other time (i.e. the Customers is leaving the next day), then no fees are payable by the Customers.
The call on weather is at the absolute discretion of Fly Bali Heli pilot. Fly Bali Heli does not fly in heavy rain/ poor visibility or when thunderstorms are in the area of flight.
Fly Bali Heli Helicopter do not take any responsibility and we are not liable for any costs associated with airfares, accommodation or anything else that occurs when the helicopter flight unable to operate due to any factor beyond our control.
Customers and Fly Bali Heli shall have the right to stop work whenever any unsafe acts or unsafe conditions are observed which could jeopardize the well-being of personnel and/or equipment.
The obligation to perform the helicopter services is subject at all times to force majeure.
In this Reservation, Force Majeure means any event or circumstances not within the control of FLY BALI HELI and which by the exercise of reasonable care it is not able to overcome, including any:
act of God
any cancellation or delay to an Aircraft caused by:
the effects of weather (including, without limitation, storms, rain, hail, fog, dust, frost or ice)
Cancellation or delay to an Aircraft due to complying with air traffic controllers;
any additional or unusual security requirements imposed by any Government Entity arising from a specific threat or incident or delays resulting from actions of airport security staff or police in relation to specific passengers or cargo;
fire, flood or earthquake;
strike, industrial action of an industry wide nature;
war, insurrection, civil disturbance, land owner disputes;
a total loss of the Aircraft; and/or
any act, order or demand of any court or any government or governmental body.
FLY BALI HELI will as soon as reasonably practicable notify Customers of the occurrence and details of any event or circumstance giving rise to the Force Majeure, the estimated delay in performance resulting from the Force Majeure and the steps that it intends to take to overcome or mitigate such event or circumstance.
Fly Bali Heli will not be liable for any failure in the fulfillment of any of its responsibilities under this Agreement of for any loss, damage or claim resulting either directly or indirectly from the Force Majeure event to the extent that such failure, loss, damage or claim is due to any delay, interruption, loss or damage occasioned by the Force Majeure.
